Destiny Slater / Sakeozo’s
Art Commission Terms of Service
General
- These are my general terms for all my commissions, personal and professional. A client or a project may have its own written agreement with different terms. Where the two are different, the agreement wins.
- By ordering or paying, you agree to these terms. I may update them, but the version you agreed to when you ordered is the one that applies to your commission.
- I’m here to help make the process smooth and enjoyable for you! Once I send you your commission files, please be sure to save them for future use. I keep your files for 30 days after I deliver them, and then I may delete them. Saving them right away keeps them safe for you.
- I deliver digital files only: a PNG for illustrations, and a GIF plus a video file for animations, each with and without my watermark. The files are yours to keep. The copyright stays with me (see OWNERSHIP).
- All artwork is signed with my online alias (Sakeozo) except for NSFW artwork under a different alias. I will reveal my NSFW art account alias to you if you commission me to draw something NSFW and want to know.
- You’ll receive the full-resolution files, one with my watermark and one without. Please keep the unwatermarked version private and avoid sharing it publicly, as this helps prevent art theft.
- Unless you request otherwise, I’ll post a watermarked version of your commission in my portfolio and on my social media. If you’d like me to wait until a set date, or not post it at all, just tell me before I start.
- I draw everything by hand. I don’t use AI to make your art.
- If you ever have questions or feedback about your commission, please don’t hesitate to reach out! I want you to feel confident and excited about your final piece.
Payment
- For a custom commission, half of the price is due before I start, and the other half is due when you approve the rough sketch. Ready-made commissions on Ko-fi are paid in full when you order.
- You can ask for a payment plan on any order of $1000 or more.
- If we have a professional project and it is expected to last for more than a month, I’ll send you an invoice in the first week of each month. Payment is due within 14 days of the invoice.
- Each invoice shows its due date. If a payment is more than 7 days past that due date, I add a 5% late fee.
- If I need to cancel your commission, you’ll receive a full refund, regardless of the progress made. If you decide to cancel, I offer refunds based on how much work has been completed. For example, if I’m halfway done, you get back 50% of what you paid.
- If you cancel before I start, I refund everything. Once I start, I keep a cancellation fee that covers the work I’ve done. It’s never less than 25% of the price. Refunds go back the way you paid.
- Refunds aren’t possible after completion.
- If something’s wrong, please email me first at destiny@sakeozo.com and we’ll sort it out together. If you open a chargeback or payment dispute without talking to me first, I’ll stop work, and you may not use the art until it’s settled.
- Tips are welcome and appreciated!
Alterations
- Please have all the details ready for your commission so we can get it just right!
- Small changes are free: up to 2 rounds at the sketch stage and 1 round after coloring starts.
- Larger changes, like redoing poses or redesigning characters, cost extra: 25% of the base price after the rough sketch is approved, or 50% once coloring has started.
- Extra rounds are priced case by case. Before any extra round or big change, I tell you the price, and I start only after you approve it.
- If the scope changes, I’ll tell you how that changes the price and the timeline before I go on.
- Once I deliver the final files, the commission is complete, and I can’t make more changes.
Timeline
- I work through commissions in the order they’re received and will do my best to provide an estimated completion date.
- You’re welcome to request updates along the way, at no extra cost!
- I work Monday to Friday. To keep burnout at bay, I take Friday evenings, weekends and holidays off, so please plan your deadline around that.
- If I’m sick or something comes up, I’ll tell you as soon as I can and give you a new date. If the new date doesn’t work for you, you can cancel for a full refund.
- If I’m waiting on you and don’t hear from you for 30 days, I’ll pause your project. After 60 days, I’ll close it. If you’d like to go on after that, we’ll start a new project with a new agreement.
Limitations
I reserve the right to decline any commission if it’s outside my comfort zone or for other reasons, such as:
- Copyrighted characters or material, unless the owner gave you permission and you can show me proof. Fan characters are fine.
- Anyone under 18. I only take commissions from adults.
- Real-life people who haven’t agreed to be drawn. I need proof of their consent.
- Disrespectful behavior toward me.
- Anything else that makes me uncomfortable.
Price alteration
These can change the final price:
- A planning fee, when planning goes well beyond a normal back-and-forth. I’ll tell you the price before it applies.
- A bigger scope than we first agreed
- Complex character designs or requests
- Additional characters
- A detailed background
- Text-based references instead of visual references
- A rush deadline
- Licensing (for business use, 20 to 40% on top of the price, or a royalty we agree on)
- A commission that requires a significant amount of changes and back and forth
I set prices per project, and I may adjust a quote or decline a project.
Discounts are available for:
- Ko-fi supporters
- Quick, simple pieces
- Something I really enjoy drawing, like Sonic the Hedgehog, silly geckos, or my own original characters
Ownership
- I, Destiny Slater (Sakeozo), keep the copyright to all the art I make, including your commission. Commissions are for personal and non-profit use only unless we’ve agreed on a license. If you’d like a license for business use, or to buy the rights outright, email me at destiny@sakeozo.com.
- A license lets you use the art for the purpose we agree on. Unless we agree otherwise in writing, it isn’t exclusive, so I can still show the art in my portfolio. If only you may use it, that’s an exclusive license, and it costs more.
- When you use the art for business under a license, please credit “Art by Sakeozo” wherever credits are shown, unless we agree otherwise.
- You’re welcome to post the artwork on your personal website, gallery or social media. Please credit me and link back to https://www.sakeozo.com/ or tag me at @sakeozo.
- You may NOT edit the art, resell it, use it to make money, sell it as an NFT, or use it with AI in any way, including AI training, AI image tools and AI style copies. These uses go against my values, so please respect them.
Index
- Commission: The form of service provided by the artist (me) to the client (you) per the commission agreement.
- NSFW: Short for “Not Safe For Work”. It means adult content that people shouldn’t open in public, like at work or school.
Questions about any of this? Ask me before you order.
